Dutch Box 3 Rethink Spares Stocks From Paper-Gains Tax, but Self-Held Crypto May Keep Paying

The Dutch cabinet has revised its plan for taxing investment returns, and the change splits stocks from self-held crypto. In a letter to parliament on September 29, Prime Minister Rob Jetten, Finance Minister Eelco Heinen and State Secretary Eelco Eerenberg said shares, bonds, options and similar financial instruments will move to a capital gains tax from 2028. Investors in those assets would pay the 36% box 3 rate only when they sell.

Directly held cryptocurrency is not on that list. Under the pending Actual Return Box 3 Act, bitcoin in a personal wallet would therefore still be taxed every year on its increase in value, even if nothing is sold. The cabinet aims to bring the remaining asset classes into the sale-based system by 2030. Crypto ETPs bought through a broker could qualify as financial instruments, giving indirect exposure a timing advantage over holding coins yourself. The plan also reportedly cuts the tax-free allowance to around €1,000.

Reaction in the Dutch crypto community has been sharp. Analyst Michaël van de Poppe wrote on X: “They want all of the control. They don’t want that you own something.” Critics also warn that volatile paper gains can disappear before the tax bill arrives.

Nothing is final yet. The Senate put the underlying bill on hold in June while awaiting a revised version, and the cabinet needs Senate approval before the end of 2026 to launch the new system in 2028.
